Some of the bravest people I’ve ever met are not adults, they’re children who arrived in the States alone from Guatemala, Mexico, and Honduras. They didn’t come here for adventure. They came because it was the only way to survive. 

These youth are eligible for Special Immigrant Juvenile Status, a unique and compassionate legal pathway that recognizes their need for protection and offers them a route to lawful permanent residency.

What Is Special Immigrant Juvenile Status and How Does It Work?

Special Immigrant Juvenile Status (SIJS) is available to undocumented children under 21 who have been subjected to abuse, neglect, or abandonment by one or both parents, and for whom returning to their home country isn’t in their best interest. A court must issue a valid finding that the child cannot safely reunify and that remaining in the U.S. serves their best interest. Once granted, the child becomes eligible for a green card by filing Form I‑360 and then adjusting status via Form I‑485.

The Human Impact and Legal Hurdles

I’ve sat across from 15‑year‑olds who crossed borders on their own, with nothing but the clothes on their back and the hope that they’d find someone to help them. They told me about nights spent sleeping on bus station benches, about leaving behind family they may never see again, and about the dangers they escaped.

When they walk into my office, they’re not just “cases” or “files.” They’re kids who need safety, stability, and a chance at a future. I’ve cheered for them from the sidelines, not as their lawyer, but as someone who believes in who they are and who they’re becoming.

Some of these kids are now excelling in Chicago schools, dreaming of becoming nurses, teachers, or even lawyers. Others are getting ready to apply for college; the first in their family to do so. They are building lives not defined by fear, but by hope.

Ongoing Challenges and Policy Barriers

Yet while SIJS provides a lifeline, policy shifts have removed automatic access to deferred action and work authorization for approved SIJS youth, leaving many unable to work or fully stabilize as they await green cards.

Thousands of SIJS petitions remain pending due to visa caps, leaving youth stranded in legal limbo. And recent policy rollbacks removing deferred action protections have triggered lawsuits aimed at restoring safeguards for SIJS recipients.

The current challenges are not just legal obstacles; they are real-life barriers that can derail a young person’s future. Overcoming these barriers requires unwavering commitment, because each victory is far more than a legal win; it’s a life transformed.
