You are fleeing for your lives, running from cartel members who have marked your daughter as their next victim. They don’t see her as a child. To them, she is property—a commodity to be stolen, sold, or worse. So, you gather what little you have and escape. You endure scorching heat, sleepless nights, and endless fear. But you push forward because the only thing more terrifying than the journey is staying behind.
And then, you make it. You reach the U.S. border, a place you believe will offer you safety. You follow the law. You do everything right. You step forward, holding your child in your arms, and ask for asylum. And then, they take her away from you.
Torn Apart: A Case of Family Separation and Detention

I will never forget this case. One of my first detained clients under the Family Separation Policy (introduced by Trump during his first administration) was two years old.
Her father—desperate, exhausted, and terrified—was deceived. The officers told him he needed to step into another room for questioning, assuring him his daughter would be waiting right outside. But when he turned back, she was gone. They had taken her.
He begged, he pleaded, he did everything a father could do. But his cries fell on deaf ears. His baby—his entire world—was sent to a separate detention center, left alone in a place where she didn’t know anyone, didn’t understand what was happening, and had no way to ask for help.
She was two. She spent three months in that detention center before her father found me. Three months without her father’s embrace. Three months without a familiar face. Three months of fear and confusion.
Reuniting Families: A Battle Against the System

By the time he came to me, he was beyond desperate. And so was I. I filed a petition immediately. Then, I sued the government. I contacted every congressperson I could. I called, I emailed, I showed up. I refused to let them ignore me. But even in an emergency, even when a two-year-old’s life was at stake, the system dragged its feet.
The judge set the next hearing 25 days later. That’s 25 more days of a toddler sitting in a cold detention center, surrounded by strangers, crying for the father she couldn’t reach. Twenty-five days of me fighting, pleading, and demanding justice for her. Eventually, I won. I got her out. I reunited her with her father.
But the damage? It was already done.
Family Separation and Detention: A Widespread Issue

This is not an exception, it’s a pattern. People often assume stories like this are rare. They are not. Children—some as young as infants—are routinely taken from their parents and forced to represent themselves in immigration court. Yes, you read that right. A toddler, expected to stand before a judge, alone.
And now, it’s about to get even worse. This administration has cut federal funding for organizations like KIND, which provide free legal representation to children in detention. That means more kids will have no one to fight for them. No one to protect them. No one to stop them from being lost in this broken system.

From a legal standpoint, these separations often result in wrongful deportations, prolonged detentions, and unnecessary asylum denials. The lack of legal representation for children means that many are unable to properly advocate for themselves, leading to permanent consequences that could have been avoided with proper legal intervention.
